Welcome to Outpost. These Terms of Service ("Terms") are a legal agreement between you and Outpost Cards LLC ("Outpost," "we," "us," or "our"), the operator of the website at outpost.cards and any related services (together, the "Service").
Please read these Terms carefully. By creating an account, listing a card, browsing listings, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Outpost is a local marketplace that helps people who buy, sell, and trade Magic: The Gathering trading cards find one another based on location. You can create an account, list cards you own, browse listings near you, and get in touch with other users to arrange a deal.
Outpost is only a venue that connects users. We are not a party to any transaction between users. Specifically, Outpost does not:
All payment, exchange, and delivery of cards happen directly between users, in person, on terms the users work out themselves (for example, cash or Venmo). Any dispute, loss, or problem arising from a transaction is strictly between the users involved.
You must be at least 18 years old to use the Service. By using Outpost, you represent that you are 18 or older and that you can form a binding contract.
To use most features you must create an account through our authentication provider. You agree to:
You may not create an account using someone else's identity, share your account, or maintain more than one account to evade a suspension or ban. You are responsible for the security of the email and password associated with your account.
"User Content" means anything you submit to the Service, including card listings, condition and price information, quantities, profile details, your showcase cards, trade preferences, contact method, and any messages or descriptions you provide.
You are solely responsible for your User Content. By posting it, you represent that:
You grant Outpost a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your User Content solely for the purpose of operating and providing the Service (for example, showing your listing to nearby users). This license ends when you delete the content or your account, except for content others have already relied on or copies retained in routine backups for a reasonable period.
We do not pre-screen User Content and are not obligated to. We may remove or restrict any content, at any time, that we believe violates these Terms or could harm users or Outpost.
Every transaction and meetup arranged through Outpost is entirely at your own risk. Because Outpost is only a connection point and is never a party to a deal, you understand and agree that:
Please protect yourself. We strongly recommend that you meet in a well-lit, public place (many police departments offer designated safe-exchange zones), bring a friend when possible, inspect cards carefully before paying, and trust your instincts. Never share more personal information than a deal requires. If a situation feels unsafe, walk away.
You agree that Outpost is not responsible for and has no liability arising from any interaction, communication, meetup, exchange, payment, dispute, injury, loss, theft, fraud, or damage connected to a transaction or contact made through the Service. You release Outpost from any claims related to the conduct of other users.
You agree not to use the Service to:
Contact information shown to you on Outpost is provided only so you can arrange a transaction with that specific user. Using it for any other purpose is prohibited.
Outpost's rights. The Service itself, including its name, logo, design, layout, and software (but not User Content or third-party content), is owned by Outpost or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our permission.
Wizards of the Coast. Magic: The Gathering, including card names, card images, card data, and related marks, is the intellectual property of Wizards of the Coast LLC. Outpost is an independent, fan-made marketplace. It is not produced, endorsed, sponsored, or affiliated with Wizards of the Coast in any way. Card images and data displayed on the Service are used to help users identify cards and are provided through third-party sources. All rights in that content belong to their respective owners.
The Service relies on third-party providers, including hosting, database and authentication, and card data services. Your use of the Service may be subject to those providers' terms, and we are not responsible for their acts, omissions, availability, or content. Card data and images come from third-party sources and may contain errors; we do not guarantee their accuracy.
You may stop using Outpost and delete your account at any time.
We may suspend or terminate your account or access to the Service at any time, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for Outpost or other users, or for any other reason at our discretion. On termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent allowed by law, Outpost disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, that listings or card data will be accurate, or that any transaction, user, card, or meetup will meet your expectations. Any material you obtain through the Service is accessed at your own discretion and risk.
To the fullest extent allowed by law:
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
You agree to defend, indemnify, and hold harmless Outpost and its owners, operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, your transactions or interactions with other users, or your violation of these Terms or any law or third-party right.
These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws rules. You agree that any dispute not resolved informally will be brought in the state or federal courts located in Ada County, Idaho, and you consent to the personal jurisdiction of those courts.
Before filing anything, you agree to first try to resolve the dispute informally by contacting us at the address in Section 16 and giving us a reasonable chance to respond.
We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms. If we make material changes, we will update the "Last updated" date and take reasonable steps to notify users. Continuing to use the Service after changes take effect means you accept the updated Terms.
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them freely. These Terms are the entire agreement between you and Outpost regarding the Service.
